A Guide to Child Support and Extraordinary Expenses in North Carolina | Allan Brandon Tise, PLLC, Attorney at Law

May 21, 2022

When you seek custody of your children in a divorce, child support payments are often a big topic of discussion. Random amounts are not just thrown out on the table during a court hearing or meditation. Instead, lawyers use tools to calculate estimated child support costs. The cost calculations include the income of the family, medical expenses, and obligations to other children. One category you will come across through the child support process in North Carolina is extraordinary expenses. Learn what those expenses mean, how a lawyer calculates them, and what additions you could have to your child support.

Private Schools

One of the main costs associated with extraordinary expenses is private schools. Judge have to determine the cost is reasonable, necessary, in the child’s best interest and usually that public school cannot meet that need. This is often a difficult sell to the judge.

Special Schools

If your child has a specific interest or talent, then child support may help pay for special schools. The special schools could include a school that is separate from their traditional learning or a school that encompasses special skills and a traditional education. This is a case by case factual determination.

Transportation Between Homes

One of the biggest changes that comes with divorce and child custody agreements can be transportation between homes. You will often have to pick up your child, meet halfway, and make plans for exchanges. Whether you move or your former partner moves, you may find transportation costs add up.
In extreme cases, you will have to pay for flights for long-distance custody agreements. In smaller cases, you will have to pay for excess gas costs. Transportation costs are often put under extraordinary circumstances, and you could possibly receive child support funds to help pay for those travel costs.
A lawyer can help determine the distance you travel and what transportation costs come with those travels to determine how much a court should add to the child support.
